La suspensión del director de la Lotería Nacional, Luis Maisichell Dicent, de acuerdo al propio decreto 334-21, se realiza por la investigación que realiza el ministerio público luego que saliera a la luz el fraude del sorteo nocturno del primero de mayo.
En su artículo primero, este decreto establece que la tregua en las funciones de Dicent se hace de conformidad al artículo 88 de la Ley Núm. 41-88 de Función Pública, que indica que si resulta “conveniente” para una investigación judicial o administrativa de un funcionario se haga una suspensión con disfrute de sueldo.
“Cuando para realizar una investigación judicial o administrativa fuere conveniente, a los fines de la misma, suspender a un servidor público, la suspensión será con goce de sueldo y tendrá una duración hasta de sesenta días continuos, lapso que podrá ser prorrogado por una sola vez. La suspensión con goce de sueldo terminará por revocatoria de la medida, por decisión de sobreseimiento, por absolución en la investigación o por imposición de una sanción”, establece el artículo 88.
Asimismo, uno de los considerandos indica que mientras perdura la investigación del ministerio público, resulta oportuno, tanto para el correcto desempeño de la Lotería Nacional, como para la propia investigación que las funciones que desempeña Luis Maisichell Dicent, sean asumidas por otro funcionario.
Teófilo José Abrahán León Tabar Manzur, será el funcionario que asumirá estas funciones de manera interina, de forma provisional y honorifica.
Por el caso de la Lotería Nacional, la Procuraduría General de la República la presentadora de televisión, Valentina Rosario Cruz, el no vidente Miguel Mejía, quien dijo que le ofrecieron 800 mil pesos para que fuera cómplice del fraude.
De igual forma, el presidente de la Federación Nacional de Bancas de Loterías (Fenabanca), Rubén Jiménez y abogados de otros implicados.
